1. Acceptance of these terms

These Terms & Conditions ("Terms") form a legally binding agreement between you ("you" or the "user") and [LEGAL ENTITY NAME], a company registered in New Zealand (NZBN [NZBN]), trading as DealRadar ("DealRadar", "we", "us", "our").

By creating an account, accessing, or using dealradar.co.nz or any related service (together, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. About DealRadar

DealRadar is an online price-tracking tool. You add product links to a wishlist, we periodically check the listed price on the relevant retailer's website, and we send you an alert when the price drops below the threshold you set (or by the amount you chose). We are not a retailer, we do not sell products, and we are not party to any purchase you make from a third-party retailer.

3. Eligibility and accounts

  • You must be at least 16 years old to create an account.
  • You must provide accurate information and keep it up to date.
  • You are responsible for all activity that happens under your account and for keeping your password confidential.
  • You must tell us promptly if you suspect any unauthorised access to your account (email info@dealradar.co.nz).

4. The Service and how it works

When you add a product link, we periodically fetch publicly visible pricing data from the retailer's page. How often we check depends on your plan and on the retailer's site behaviour. We will attempt to send alerts by the channels you have enabled (e.g. app notification), but we do not guarantee that every price change will be detected or that alerts will be delivered instantly.

We may, from time to time, add, change, or remove features, supported retailers, or notification channels. We will make reasonable efforts to give advance notice of material changes.

5. Plans, pricing and billing

5.1 Free plan

DealRadar offers a free tier with limits on things like the number of tracked items or the frequency of price checks. Features and limits of the free plan are described on our pricing page and may be updated from time to time.

5.2 Paid plans

Paid plans are described on our pricing page. Prices are shown in New Zealand dollars (NZD). DealRadar is not currently registered for GST, so the prices you see are the total price payable and no GST applies. Where a plan is shown in another currency at checkout (for example, for overseas users), the payment provider's exchange rate will apply.

Paid plans are typically billed in advance on a recurring basis (monthly or annually, as selected). By subscribing, you authorise us (and our payment provider) to automatically charge your payment method at the start of each billing period until you cancel.

We may change subscription prices with at least 30 days' notice. If you do not agree to a price change, you can cancel before it takes effect.

6. Cancellations and refunds

You can cancel a paid plan at any time from your account settings. Cancellation stops future billing; access to paid features continues until the end of the period you have already paid for.

We do not generally offer refunds for partial billing periods, except:

  • where you are entitled to a remedy under the NZ Consumer Guarantees Act 1993 or the Australian Consumer Law (see section 12);
  • where we make a material adverse change to your plan that you do not accept;
  • where we agree to a refund in our reasonable discretion (for example, duplicate billing or a technical fault that made the Service materially unavailable).

7. Affiliate links and sponsored content

DealRadar may earn a commission when you click on certain product links and make a purchase from a third-party retailer (an "affiliate link"). We may also show sponsored deals or ads that are paid promotions.

Affiliate and sponsored items are labelled as such where required by law, including the NZ Fair Trading Act 1986 and Australian Consumer Law. Earning a commission does not change the price you pay, and we do our best to show recommendations objectively. Decisions about what to buy are yours.

8. Acceptable use

You agree not to:

  • use the Service in breach of any law or third-party rights;
  • reverse engineer, scrape, or resell the Service or our data outside of normal use;
  • attempt to gain unauthorised access, interfere with security features, or disrupt the Service;
  • upload malicious code, or submit content that is illegal, defamatory, infringing, or abusive;
  • impersonate another person or misrepresent your affiliation with any entity;
  • use the Service to harass, stalk, or send unsolicited marketing to others.

9. Intellectual property

The Service, including the DealRadar name, logo, code, design, and content (other than your wishlist content), is owned by us or our licensors and is protected by copyright, trade mark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms.

You retain ownership of content you submit (such as product links and notes). You grant us a worldwide, royalty-free licence to host, store, reproduce, and display that content as necessary to operate the Service.

10. Third-party retailers and prices

Prices shown in DealRadar come from third-party retailer websites and can change at any time. We try to show accurate information, but:

  • we do not guarantee that a price, discount, or stock level will still be available when you click through;
  • retailers may change terms, restrict regions, or limit quantities;
  • any purchase is a contract between you and the retailer, not with DealRadar.

11. Disclaimers

To the maximum extent permitted by law and subject to section 12, the Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, completely secure, or that alerts will be delivered accurately or on time.

12. Consumer guarantees (NZ and AU)

Nothing in these Terms limits or excludes your rights under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986, or the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), where those laws apply and cannot lawfully be excluded.

Where you use the Service for business purposes, you agree that the Consumer Guarantees Act does not apply (to the extent permitted by section 43 of that Act).

13. Limitation of liability

To the maximum extent permitted by law, and subject to the non-excludable rights described in section 12:

  • we are not liable for any indirect, incidental, consequential, or special loss or damage, including loss of profits, revenue, savings, goodwill, data, or missed deals;
  • our total liability to you for all claims arising out of or in connection with the Service in any 12-month period is limited to the greater of (a) the amount you paid us for the Service in that period, or (b) NZD 1.

14. Indemnity

You agree to indemnify and hold us harmless from any reasonable claims, losses, and costs (including legal fees) arising out of your breach of these Terms, your misuse of the Service, or your breach of any law or third-party rights.

15. Suspension and termination

We may suspend or terminate your access to the Service if:

  • you materially breach these Terms and do not remedy the breach within a reasonable period after we notify you;
  • your payment fails and is not resolved after reasonable notice;
  • we reasonably believe your account is being used for illegal, fraudulent, or abusive activity;
  • we are required to do so by law.

You can close your account at any time from your account settings or by emailing info@dealradar.co.nz. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, liability, and governing law) will continue to apply.

16. Changes to the Service or these Terms

We may update these Terms from time to time. If the changes are material, we will notify you by email or via a prominent notice in the Service at least 7 days before they take effect. Continued use of the Service after a change means you accept the updated Terms. If you do not agree, you should stop using the Service and may cancel any paid plan.

17. Governing law and disputes

These Terms are governed by the laws of New Zealand. The courts of New Zealand have non-exclusive jurisdiction over any dispute. If you are an Australian consumer, nothing in this clause affects the non-excludable rights you have under Australian consumer law.

Before starting any legal proceedings, we both agree to try in good faith to resolve the dispute by contacting info@dealradar.co.nz and allowing at least 30 days for resolution.

18. General

  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
  • Severability: if any clause is held unenforceable, the rest remains in effect.
  • No waiver: a failure to enforce a right is not a waiver of that right.
  • Assignment: you may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a corporate transaction.
  • Notices: we may send you notices by email to the address linked to your account. You can send notices to us at info@dealradar.co.nz.
  • Force majeure: neither party is liable for delay or failure caused by events beyond its reasonable control.
